Privacy Policy
Last updated: October 4, 2026
This policy explains how UppearNow collects, uses and protects personal data when you visit uppearnow.com, contact us, book a call or work with us. We've written it in plain English so you can see exactly what happens to your information.
If anything here is unclear, email info@uppearnow.com and a member of our team will help.
1. Who we are
UppearNow is a digital marketing and AI technology agency offering SEO, AI search optimization, content, link building, websites, social media, marketing automation and custom AI builds.
- Privacy contact: info@uppearnow.com
In this policy, "UppearNow", "we", "us" and "our" mean the business named above.
2. Two roles we play
When we decide how your data is used. For website visitors, people who contact us, prospects and our own clients' contacts, we are the controller (or "data fiduciary" under India's DPDP Act). This policy covers that data.
When we handle data for a client. While delivering services, we may access personal data that belongs to our clients, such as analytics data, CRM records, email lists or chatbot conversations. In that case we act as a processor or service provider on the client's instructions, under our agreement with them. If your data reaches us this way, the client's own privacy policy applies, and requests about it should go to that client first. We'll help them respond.
3. What we collect
Information you give us
- Contact details: your name, email address, phone number, company and website.
- Messages: what you write in our contact form, emails and chats, including the service you're interested in.
- Call details: notes from discovery and review calls, and recordings or transcripts only when you agree to them at the start of the call.
- Billing details: billing name, address, tax ID and payment records. Card details are handled by our payment provider, and we never see or store full card numbers.
- Account access: user invitations you send us for tools like Google Search Console, Google Analytics, your website admin or CRM. We ask for user-level access so you never need to share passwords.
Information collected automatically
- Device and log data: IP address, browser type, device, operating system, referring page and the pages you view.
- Cookies and similar technologies, described in section 8.
Information from other sources
- Publicly available business information, such as your website, public profiles and search data, which we review when preparing an audit or proposal you've asked for.
- Referrals from partners or existing clients, with the details they choose to share.
We don't ask for sensitive personal data (such as health, financial account, biometric or government ID details), and we ask you not to send it through our forms.
4. How we use it, and our legal basis
| Purpose | Examples | Legal basis (UK/EU GDPR) |
|---|---|---|
| Replying to you | Answering messages, booking calls, sending proposals | Steps before a contract, or legitimate interests |
| Delivering services | Running audits, campaigns, reports and AI builds | Performance of a contract |
| Billing and records | Invoicing, tax, accounting and audits | Legal obligation |
| Improving our site | Measuring visits and fixing errors | Consent for non-essential cookies, legitimate interests for essential ones |
| Marketing | Newsletters and service updates | Consent, or legitimate interests for existing clients where the law allows |
| Security and legal claims | Preventing spam and fraud, enforcing our terms | Legitimate interests or legal obligation |
Where the DPDP Act applies, we rely on your consent or a legitimate use the Act allows, and you can withdraw consent at any time by emailing info@uppearnow.com.
5. How we use AI tools
We use AI services from established providers to help analyze public website and search data, draft and edit content, summarize call notes and build client tools. Personal data is kept to the minimum each task needs, and we don't enter sensitive personal data into AI tools. These providers process data under their business terms, which limit how they can use it.
We don't make decisions about you based solely on automated processing that produce legal or similarly significant effects.
6. Who we share it with
We share personal data only with people who help us run the business, and only as much as they need:
- Service providers: website hosting, email and email marketing, form tools, scheduling, video calls, payment processing, accounting, analytics, CRM and AI providers.
- Specialist contractors: writers, developers and outreach specialists working on a client account under confidentiality terms.
- Professional advisers: lawyers, accountants and insurers, under a duty of confidentiality.
- Authorities: when the law requires it, or to protect our rights, our clients or the public.
- A buyer or successor: if UppearNow is involved in a merger, sale or reorganization, with this policy continuing to protect your data.
We don't sell personal information, and we don't share it for cross-context behavioral advertising.
7. International transfers
Our team and service providers work across several countries, including India and the United States, so your data may be processed outside the country where you live. When we transfer data from the UK, EU or other regions with transfer rules, we use recognized safeguards such as the European Commission's Standard Contractual Clauses or the UK International Data Transfer Addendum, along with the security measures in section 10.
8. Cookies
Cookies are small files stored on your device. We use:
- Essential cookies that keep the site and forms working and secure. These can't be switched off.
- Analytics cookies that show us which pages people visit, so we can improve the site.
- Marketing cookies, only if we add them later and only with your consent.
Visitors from the UK, EU and other regions that require it will see a consent banner, and non-essential cookies stay off until you choose to allow them. You can change your choice at any time through the cookie settings link in the footer or your browser settings. Where required, we treat a Global Privacy Control signal as a valid opt-out.
9. How long we keep it
| Data | How long |
|---|---|
| Inquiries that don't become projects | Up to 24 months from your last contact |
| Client contracts, invoices and tax records | As long as tax and company law requires, usually up to 8 years |
| Project files and reports | For the length of the engagement plus 24 months, unless the client asks us to delete them sooner |
| Call recordings and transcripts | Up to 12 months |
| Marketing preferences | Until you unsubscribe, plus a suppression record so we don't email you again |
When data is no longer needed, we delete it or make it anonymous.
10. How we protect it
We use encryption in transit, two-factor sign-in on our accounts, a password manager, role-based access and regular reviews of who can reach client systems. Access to client tools is removed when the work ends. No system is perfectly secure, so if a breach affects your data, we'll notify you and the relevant regulators within the time the law requires.
11. Your rights
Depending on where you live, you may have the right to:
- Access the personal data we hold about you and get a copy.
- Correct data that's wrong or incomplete.
- Delete your data, or ask us to stop using it.
- Restrict or object to certain uses, including direct marketing.
- Receive your data in a portable format.
- Withdraw consent you've given, without affecting earlier use.
- Complain to a data protection regulator.
